BAPA’s mission is to preserve an existing easement from Echo Springs Road to Briones Regional Park up the EBMUD utility road used by the public for 65 years.
Why Fight for Our Briones Access
One hike from your home without using your car up the EBMUD road from Echo Springs to the Briones entrance will answer that question. Whether for great exercise, experiencing the incredible natural beauty (especially this Spring) or searching for spiritual peace, a trip to Briones will invigorate and stimulate all your senses.
Our easement up into Briones is our legal right, as supported by the two injunctions awarded by the Court. We can't stand back and allow Knarr to illegally rip this incredible asset from our neighborhood. We are only demanding access up the EBMUD road, which avoids the home and barn sites set to be constructed. We have no desire to be intrusive or violate Knarr's privacy. We only seek to confirm our easement rights.
There are also certain bonuses inherent in this Briones Trailhead. Entrance #54 opens to the least traveled trails in Briones due to the degree of difficulty and distance from other trailheads with car parking. This winter the Springhill Trailhead has been closed since early January with no reopening projected due to winter storms. Thanks to the geological layout of Spangler and Table Top we have had access all year.
Whether you visit Briones daily, weekly, monthly, only several times a year or have never taken the opportunity to experience the Park, there is an added value to your home. The proximity of the Briones access has attracted many home buyers and is an important asset to the value of your property. Current Status
Based upon our request the Contra Costa County Superior Court has ordered a Preliminary Injunction that the EBMUD access road from Echo Springs to Briones is to remain OPEN AND UNOBSTRUCTED FOR ALL hikers , bikers and equestrians. This order will remain in place until our case to confirm access is settled or goes to trial.
It should be noted that Restraining Orders are rarely given. There must be a very strong probability that the complaint will succeed. We have had two judges award Restraining Orders and Injunctions as evidence of the strength of our case.
THE CURRENT LITIGATION REQUIRES NEIGHBORHOOD FINANCIAL CONTRIBUTIONS. WITHOUT THIS LITIGATION, THE EBMUD ROAD WOULD BE PERMANENTLY BARRICADED REGARDLESS OF OUR LEGAL RIGHTS FOR EASEMENT ACCESS.
