Litigation
BAPA has been forced into litigation to preserve the public's easement up the EBMUD utility road from Echo Springs Road to Briones Regional Park, access used by the neighborhood for over 60 years. Without this litigation we would currently be barricaded from our rightful easement forever. The only way to successfully fight Knarr for access is with a powerful and professional response. We have done this.
We are very fortunate to have hired as our attorney, Drew Bassak of Hanson Bridgett. Drew lives on Echo Springs several houses from the EBMUD gate. He is an avid Briones hiker and has a personal stake in fighting this case. This litigation is expensive, despite Drew's many hours of pro bono work for our case.
Many legal actions have been filed and we have linked some of them on this website. For the sake of expediency we would recommend reading three key documents. The first is the First Amended Complaint that replaces our original complaint of October and incorporates EBMUD as a party of the case as required by the court. The second is the Order After Hearing that grants the Preliminary Injunction. The third is the Motion for Summary Adjudication.

With two injunctions from two judges and the supporting Declaration from EBMUD we are in a very strong position. Knarr's only defense is to stretch out the litigation hoping we lose interest or are unable to continue to pay the costs of litigation. It should be noted there is precedent for Knarr to reimburse some of our legal fees although there certainly is no guarantee.
